Ross Construction Hire

These Terms and Conditions apply to the hiring of excavation equipment from Ross Construction Hire. By hiring our equipment, you agree to comply with these terms.

1. Definitions

1.1 "The Company" refers to Ross Construction Hire.
1.2 "The Hirer" refers to the person or entity hiring equipment.
1.3 "Equipment" refers to any machinery or tools hired out by Ross Construction Hire.

2. Hire Period

2.1 The hire period starts when the Hirer takes possession of the Equipment and ends when it is returned to the Company.
2.2 Extensions must be agreed upon in advance and may incur additional charges.

3. Hirer Responsibilities

3.1 The Hirer is responsible for inspecting the Equipment upon collection or delivery to ensure it is in good working condition.
3.2 The Equipment must be used safely and for its intended purpose only.
3.3 The Hirer assumes all liability for loss, damage, or theft of the Equipment during the hire period.
3.4 The Hirer must not loan, sublet, or transfer the Equipment to any third party.

4. Payment Terms

4.1 Payment must be made in full before the hire period begins unless otherwise agreed.
4.2 Late payments may incur additional fees.
4.3 A security deposit may be required and will be refunded upon return of the Equipment in acceptable condition.

5. Delivery and Collection

5.1 Delivery and collection services are available at an additional cost.
5.2 The Hirer must ensure safe and accessible delivery and collection points.
5.3 The Hirer is responsible for returning Equipment by the agreed date and time. Late returns may incur extra charges.

6. Maintenance and Care

6.1 The Hirer must maintain the Equipment in good working order and report any damage or malfunctions immediately.
6.2 Any repairs resulting from misuse or negligence will be charged to the Hirer.

7. Liability and Insurance

7.1 Ross Construction Hire is not liable for any injury, loss, or damage resulting from the use of the Equipment.
7.2 The Hirer must ensure adequate insurance coverage for the hired Equipment during the hire period.

​

8. Cancellations and Refunds

8.1 Cancellations made at least 48 hours before the hire start date may be eligible for a refund, less an administrative fee.
8.2 Cancellations within 48 hours of the hire start date may forfeit the hire fee.

​

9. Termination of Hire

9.1 The Company reserves the right to terminate the hire agreement and reclaim the Equipment if the Hirer breaches any terms or if the Equipment is at risk of damage or loss.

10. Dispute Resolution

10.1 Any disputes arising under this agreement will be resolved through negotiation in good faith. If unresolved, disputes may be referred to mediation or legal proceedings under the jurisdiction of Logan Magistrate Court, QLD.

​

11. Miscellaneous

11.1 These terms may be updated by Ross Construction Hire from time to time.
11.2 Any amendments will be posted on our website and will apply to new hire agreements.
